# Terms of Service

Scope

These Terms apply to the **hosted nSelf services**: cloud.nself.org, task.nself.org (live app), claw.nself.org (hosted ɳClaw), and related hosted services (collectively, the "Service").

The **nSelf CLI** is MIT licensed open-source software. No Terms of Service apply to the CLI itself. You can use it however you want.

**Pro plugin licensing** is governed by the Plugin Marketplace Addendum (Section 17).

1. Acceptance and Eligibility

By creating an account or using the Service, you agree to these Terms, our [Privacy Policy](/legal/privacy), our [Acceptable Use Policy](/legal/acceptable-use), and our [Cookie Policy](/legal/cookies).

You must be at least 18 years old to enter into this agreement. Users aged 13-17 may use the Service with verified parental or guardian consent. Users under 13 may not use the Service.

2. Account Responsibilities

You are responsible for:

- Providing accurate and current account information - Keeping your credentials (password, API keys, license keys) secure - All activity that occurs under your account - Notifying us promptly at security@nself.org if you suspect unauthorized access

We may suspend accounts with obviously false registration information.

3. Acceptable Use Policy

You must comply with our [Acceptable Use Policy](/legal/acceptable-use), which prohibits:

- Storing or distributing illegal content or child sexual abuse material (CSAM) - Sending spam or unsolicited bulk messages - Hosting phishing pages, malware, or botnets - Mining cryptocurrency on our infrastructure - Reverse-engineering Pro plugins beyond what the license permits - Reselling access to the Service without a reseller agreement - Circumventing license validation or telemetry in ways that violate the Pro plugin license - Launching denial-of-service attacks against any target - Attempting to access other users' data or infrastructure - Using the Service in any way that violates applicable law

Violations result in account suspension or termination. See the AUP for enforcement details.

4. Service Description and Changes

The Service provides managed nSelf backend instances, hosted applications (ɳTasks, ɳClaw), plugin marketplace access, and related tools.

We may modify the Service with 30 days' email notice for material changes. We will not remove core functionality you are paying for without offering a pro-rated refund or equivalent alternative.

5. Fees, Billing, and Refunds

### Pricing

Current pricing is published at [nself.org/pricing](/pricing). Prices may change with 30 days' notice.

### Billing

Paid plans are billed monthly or annually via Stripe. Annual plans receive approximately 17% discount versus monthly billing.

### Cancellation

You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period. You retain access until that date.

### Refunds

- **Annual plans:** Pro-rated refund if you cancel within 14 days of purchase or renewal - **Monthly plans:** No refund for partial months - **Chargebacks:** Disputed charges are investigated. Fraudulent chargebacks may result in account termination

6. Service Level and Disclaimers

### Hosted services (cloud.nself.org, task.nself.org, claw.nself.org)

We target 99.9% monthly uptime for hosted services. Our uptime commitment and credit schedule are documented in our [Service Level Agreement](/legal/sla).

We will notify users of planned maintenance at least 48 hours in advance via email and status page.

### Self-hosted nSelf instances

**Self-hosted instances come with NO WARRANTY and NO SLA.** You are solely responsible for the operation, uptime, security, backups, and maintenance of your self-hosted infrastructure. We provide documentation and community support, but assume no liability for self-hosted deployments.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7. Intellectual Property

### Our IP

The nSelf name, logo, brand assets, documentation, and Pro plugin source code are our intellectual property. The nSelf CLI and free plugins are MIT licensed.

### Your content

You retain all ownership rights to content you store on the Service. We do not claim any intellectual property rights over your content.

### License grant

You grant us a limited, non-exclusive license to process your content solely to provide the Service to you. This license terminates when you delete your content or your account.

8. User Content and AI

We do **not** use your content to train AI models. Your prompts, responses, files, and memory graphs in ɳClaw are your data. See our [Privacy Policy](/legal/privacy) Section 7 for full AI-specific disclosures.

Third-party model providers (OpenAI, Anthropic, Groq) are configured with zero-retention / no-training API settings. You can opt to use only self-hosted models if you prefer your data never leaves our servers.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NSELF'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO NSELF IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

THIS LIMITATION APPLIES TO ALL CLAIMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY.

THIS LIMITATION DOES NOT APPLY TO: - Liability arising from gross negligence or willful misconduct - Liability that cannot be excluded under applicable law - nSelf's indemnification obligations under Section 10

IN NO EVENT SHALL NSELF BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10. Indemnification

### Your indemnification of us

You agree to indemnify and hold nSelf harmless from claims arising from: (a) your use of the Service, (b) your content, (c) your violation of these Terms or applicable law.

### Our indemnification of you

We will indemnify you against third-party claims that the Service (excluding your content and third-party integrations) infringes their intellectual property rights, provided you promptly notify us and give us control of the defense.

11. Termination

### By you

You may close your account at any time from your account settings. We provide a 30-day data export window after account closure.

### By us

We may terminate your account: - **With 30 days' notice** for any reason (we will pro-rate any prepaid fees) - **Immediately** for AUP violations, fraud, abuse, or legal obligation

### Effect of termination

Upon termination, you have 30 days to export your data. After 30 days, we delete your data per our retention schedule. Sections that by their nature should survive termination (IP, liability, indemnification, governing law, dispute resolution) will survive.

12. Governing Law and Venue

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles.

[NOTE: Governing law will be set to the actual LLC formation state. If nSelf is formed as a Delaware LLC, this section is correct. If formed elsewhere, this section will be updated.]

13. Export Controls

You represent and warrant that: - You are not located in a country subject to US government embargo - You are not listed on any US government list of prohibited or restricted parties (OFAC SDN List, BIS Entity List) - You will not use the Service in violation of any applicable export control laws

14. Dispute Resolution

### Informal resolution

Before filing any formal dispute, you agree to contact us at legal@nself.org and attempt to resolve the dispute informally for at least 30 days.

### Arbitration

If we cannot resolve the dispute informally, either party may commence binding arbitration under the American Arbitration Association (AAA) Commercial Arbitration Rules. The arbitration will be conducted in Wilmington, Delaware (or the nearest major city to the LLC's registered address). The arbitrator's decision is final and binding.

### Class action waiver

You agree to resolve disputes with nSelf on an individual basis. You waive any right to participate in a class action, class arbitration, or representative proceeding.

### Exceptions

Either party may seek injunctive relief in any court of competent jurisdiction for intellectual property disputes or to prevent irreparable harm.

15. Assignment

We may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of our assets. We will notify you of any such assignment.

You may not assign these Terms without our prior written consent.

16. General Provisions

- **Severability:** If any provision is found unenforceable, the remaining provisions remain in effect. - **Entire agreement:** These Terms, together with the Privacy Policy, AUP, Cookie Policy, and any applicable addenda, constitute the entire agreement between you and nSelf. - **No waiver:** Our failure to enforce any provision is not a waiver of that provision. - **Notices:** We may send notices to the email address on your account. You may send notices to legal@nself.org.

17. Plugin Marketplace Addendum

This section applies to Pro plugin licensing.

### License grant

A valid membership key grants you a non-exclusive, non-transferable license to install and use Pro plugins on the number of instances permitted by your tier.

### Restrictions

You may not: - Share, redistribute, or resell your license key - Reverse-engineer, decompile, or extract source code from Pro plugins beyond what is permitted by applicable law - Circumvent license validation mechanisms - Use Pro plugins after your subscription expires

### Revocation

We may revoke a license key for: non-payment, AUP violation, fraudulent use, or chargeback. Revocation takes effect immediately. You will receive email notice.

### Refunds for plugins

Plugin subscription refunds follow the same policy as Section 5 (14-day pro-rated for annual, no partial month for monthly).

18. Changes to These Terms

We may update these Terms from time to time. For material changes:

- We will email registered users at least 30 days before the change takes effect - We will post a notice on nself.org - Continued use of the Service after the 30-day notice period constitutes acceptance
